Terms of Agreement

I/We hereby authorize you to issue and deliver payment instructions to your Banker for collection against my/our abovementioned account at my/our above-mentioned Bank (or any other Bank or branch to which I/we may transfer my/our account) on condition that the sum of such payment instructions will never exceed my/our obligations as agreed to in the Agreement, and commencing on the sign-up date and continuing until this Authority and Mandate is terminated by me/us by giving you notice in writing of not less 20 ordinary working days, and sent by prepaid registered post or delivered to your address indicated above.

I /We understand that the withdrawals hereby authorized will be processed through a computerized system provided by the Banks.

I also understand that details of each withdrawal will be printed on my Bank statement. Such must contain a number, which number must be included in the said payment instruction and if provided to me should enable me to identify the Agreement. This number must be added to this form in section D before the issuing of any payment instruction.

I/We acknowledge that all payment instructions issued by you shall be treated by my/our mentioned Bank as if the instructions had been issued by me/us personally.

I/We agree that although this Authority and Mandate may be cancelled by me/us, such cancellation will not cancel the Agreement. I/We shall not be entitled to any refund of amounts which you have withdrawn while this Authority was in force if such amounts were legally owing to you.

I/We acknowledge that in the event of cancellation or non-payment of this account for any reason whatsoever, I/We will be handed over to the appointed lawyer and blacklisted with immediate effect.

I/We acknowledge that this authority may be ceded or assigned to a third party if the Agreement is also ceded or assigned to that third party, but in the absence of such assignment of the Agreement, this Authority and Mandate cannot be assigned to any third party.


1. Parties

The agreement is signed between Andrew William Smith (Pty) –and the client and or company.

2. Amendment to the existing agreement
The client is allowed to add any additional products or services to the agreement at any particular time during the agreement. Amendment forms need to be signed with full detail

3. Cancellation
3.1 A 20- working day written notice is required if any of the parties has any intention of cancelling the agreement. This cancellation must be sent to and
3.2 When the cancellation has been sent to the Zoomination team in the period of a monthly payment there will be one final payment via the payment platform.
3.3 By cancelling the agreement head office will be in contact with you to confirm the cancellation and
3.4 Early cancellation fee, which will be determined on notice of cancellation, will apply if the contract is terminated before the end of the term. We reserve the right to recover any loss suffered as a result of early cancellation.

4. Payments
4.1 The company will pay the relevant amount on the day as selected on the mandate of every month via the desired payment platform
4.2 When the selected debit order date is for a date after the next session in any given month, the 1st debit order will be collected immediately on a pro-rata basis depending on the number of sessions left before the 1st debit order is due to go off. This will be discussed and explained when the team contacts you.
4.3 If a payment is not made
4.3.1 The Client will have 7 days to pay the agreed amount
4.4 Sign up: As soon as the debit order has been successful – the client will be allowed to attend the next scheduled session
4.5 All payments are collected in advance.
4.6 Once-off payments can be made via Debit Order or EFT to the Andrew Williams Smith Pty ltd.’s bank account and proof of payment needs to be sent to the relevant email address with the Reference number provided.
4.7 No coaching will be provided until the agreed amount has been collected successfully
4.8 All coaching sessions are 60 minutes
4.9 All costs paid are non-refundable

5. Zoomination group coaching
5.1 All sessions will be in a group format
5.2 All sessions will be an average of one (1) hour in duration
5.3 There will be one session per week for the term and this will generally take place on Monday evenings from 8 pm to 9 pm unless otherwise communicated.
5.4 All sessions will be online via Zoom
5.5 If the payment was unsuccessful, you will not be allowed into the sessions.
5.6 The link to each session will be provided via email and WhatsApp on the day of coaching. This link may not be shared with anyone.

6. General Terms
You agree that you are bound to the terms and conditions of this Agreement, which is concluded in Pretoria, South Africa at the time you have accepted this Agreement as required.
